The Collapse of the 28-Article Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the crisis sparked by the announcement of a new 28-article proposal for resolving the conflict appeared – momentarily – to have been stabilised. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of conflicting incidents captured the harsh reality of the recent timeframe. By day, diplomatic battles are conducted: optimistic declarations are delivered from various governments. Considerable effort is expended on containing particular approaches. By night, Russian leadership clearly shows the world that, for them, military action persists as the key method for achieving "resolution".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is able to track rocket firings from across the border, a capability provided through current data. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile cruise missiles roared overhead – advanced fighter aircraft supplied to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense thundered: several firings fired to intercept a incoming threat. This was a modern interception technology at work, most likely supplied through allied countries. Every launch jolts you unexpectedly, rattling buildings. The brief panic quickly becomes sober acceptance: possibly the hostile projectile won't strike its target this time, sparing the city from ruin and another blackout.

Continuous Dangers

Not long after, a heavy machine gun opened up on a unmanned aircraft close by, part of a mobile-fire group – most likely allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it continued its flight toward its target.

Intermittently, this persisted until dawn. Kyiv faced the morning news: multiple fatalities, destruction and heating outages in many homes as a result of the evening attack. As typically, everyone still continued their routines – experiencing conflict. But those 24 hours illustrated Ukraine's essential dependence on external assistance – a reliance that neighboring countries are clearly incapable to fill in the near term.

Unsuccessful Negotiations

The comprehensive proposal from Washington provoked deep reactions, debate and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after prior negotiation attempts and bilateral conferences.

Every new approach from American administration unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, effectively counters. They stabilise the situation but never actually secure success. This pattern will, no doubt, continue.

Tactical Assessments

It is easy to blame specific actors of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. American leadership functions according to a principle familiar among seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The White House presumes that it is unrealistic to compel Moscow to relinquish the areas that it currently occupies in Ukraine's south or east.

The issue is that while accepting these circumstances, Washington does little to deter Moscow, through words or deeds, from believing that the situation will not evolve additionally in its benefit in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their reason to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing lives and land but avoiding a complete military breakdown until conditions improve in its benefit.

Present Conditions

Factually, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: personal goals to broker a ceasefire and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unsuitable, so that their focus does not shift toward domestic problems. And although their mission will now be considerably more difficult after recent developments, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a just a single week to terminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by US administration, pushback by Ukraine and the rest of Europe, along with pacifying measures of representatives, and finally, latest revelations, all did their job.

While new initiatives based on established approaches are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to change the course of events, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
